General Terms and Conditions (GTC)

ARTICLE 1 - MUSI'QUIZ

MS VIRTUALITY (or "the Service Provider" or "Musi'Quiz" hereafter) is a simplified joint stock company registered in the Grenoble Trade and Companies Register, under number 911 979 680, with its registered office at 22 AVENUE DE L'ILE BRUNE, 38120 SAINT-EGREVE (intra-community VAT FR23911979680). MS VIRTUALITY, operator of the Musi'Quiz activity, offers for sale the supply of services (the "Services") relating to the reservation of leisure rooms (the "Rooms") in order to be able to conclude sales contracts (the "Contracts") with a consumer (the "Purchaser"), under the terms of which MS VIRTUALITY makes one or more Rooms available to participants in the leisure activities (the "Players"); if he participates in the leisure activities, the Purchaser is deemed to be a Player.

ARTICLE 2 - PURPOSE

These general terms and conditions of sale ("GTC") are intended to regulate the relationship between Musi'Quiz and Players, in particular with regard to the provision of a Game Room.

Musi'Quiz and the players undertake to comply with the present contractual stipulations, as well as with all local and national laws and regulations, and other instructions from administrative authorities, as well as with the rules laid down by insurers where applicable.

The Game Rooms are located on Musi'Quiz premises, as indicated on its Site. Musi'Quiz has the right, at any time, to modify or have modified the terms and conditions below, as well as the rates and content displayed on its Site.

Musi'Quiz's general terms and conditions of sale are available in French only, on its website or on request at the reception desk.

The GTC are valid as soon as they are published online.

ARTICLE 3 - PRE-CONTRACT PRE-CONTRACTUAL INFORMATION

The Buyer acknowledges that he has read the General Terms and Conditions and all the information they contain, that he has accepted them before validating any order, and that they are enforceable against him in accordance with article 1119 of the French Civil Code.

ARTICLE 4 - SERVICES MUSI'QUIZ

Musi'Quiz offers game room reservation services for sale, including the use of a musical question and answer game with the following features:
- question and answer game using a digital device (screens/tablets)
- screens and buzzers made available to allow players to answer questions
- points counted and players ranked;
- various game mechanics specific to Musi'Quiz that can be modified over time.

A minimum of 4 players and a maximum of 18 players are required to use the equipment in the game room.

If requested at the time of booking, the Buyer may contact Musi'Quiz to order additional personalized services (room reservation, buffet, etc.), which will be subject to an additional quote issued by Musi'Quiz.

ARTICLE 5 - SERVICE PRICES

The prices of services offered for sale on the site are set freely by Musi'Quiz, in compliance with applicable laws and regulations. They are clearly displayed on the site and are available on request from the game room reception desk. Prices are degressive according to the number of players.

Musi'Quiz reserves the right to modify its prices at any time, but undertakes to apply the current rates indicated at the time of the order.

The price of products and services is not negotiable by the Buyer. Prices are displayed in euros, all taxes included.

Preferential rates may apply at certain off-peak times or on presentation of the student card, as indicated on the site at the time of purchase.

Only credit card payments are accepted on the site. If the booking party is unable to pay by credit card, a waiver may be granted for on-site payment by credit card, bank transfer or cash (in euros). 

Musi'Quiz has entrusted its payment system to a service provider specializing in the security of online payments and does not store any data related to the payment system in its databases.

Full or partial payment is required at the time of booking.
If the booking date is more than 2 days after the payment date, it is possible to opt for the shared payment option. Only one place is paid for at the time of booking, which is then blocked for 48 hours while the other Players make their payment. If the total payment reaches the full amount requested within the allotted time, the reservation is validated. If not, the reservation will be lost and any payments already made will be credited. Payments received will not be reimbursed under any circumstances.

In the event of cancellation by one or more Players for any reason at least 48 hours before the game session, only a credit note will be issued. This credit note will be valid for 12 months from the date of purchase. After 48 hours, the credit note will no longer be available.

No refunds will be made after a game session has been validated.

In the event that the number of players present at the time of reservation is less than the number anticipated at the time of reservation, the corresponding price difference will not be reimbursed.
In the event that the number of players present is greater than the number anticipated at the time of reservation, the price difference will be paid on site on the day of the event, within the limit of the number of players authorized for the Game Room, as indicated on the Site.

Musi'Quiz reserves the right to refuse any reservation to a person who still owes Musi'Quiz any invoiced amounts.

For any question relating to the follow-up of his Order, the Buyer must contact the Seller directly.

Business customers :

A professional customer will receive a quote upon request to Musi'Quiz. An option can be made to block a slot at the customer's request. To validate the quote, the customer must return the signed quote. Once signed, a quote is considered due.

The quotation may be cancelled by the customer free of charge if the activity takes place at least 30 days after the date of the cancellation request.

The number of players can be changed up to 7 days before the event. Once this deadline has passed, the number of players cannot be reduced. The addition of players (excluding catering services) is possible up to the day of the event and will be subject to a price adjustment.

Cancellation or the absence or delay of one or more players does not release the Customer from his payment obligation towards Musi'Quiz.

• Either before the event: 100% of the amount of the quote or a minimum deposit of 50% by bank transfer or payment link, then 50% 7 days after the event.
• On the day of the event: 100% of the amount on site by credit card, cheque or cash.

ARTICLE 6 - ORDERS

‍The order is placed online based on available reservation slots. The player chooses the date and time of his/her visit. The buyer must then identify himself by entering his surname, first name, telephone number, postal address and e-mail address.

The buyer must validate the order and proceed with payment of all or part of the reservation.

Any validation implies acceptance of the price and the GCS.

The buyer will then receive a confirmation email from Musi'Quiz within 48 hours. The sale will then be considered final.

In the event of fraudulent use of his bank card, the Buyer is invited, as soon as this use is noticed, to contact Musi'Quiz Customer Service, providing proof of this fraudulent use.

Computerized data, stored in the computer systems of Musi'Quiz and its partners under reasonable conditions of security, will be considered as proof of communications, orders and payments between the parties.
The archiving of orders may be used in case of request for proof.

ARTICLE 7 - ACCESS TO ROOMS

‍Access to the rooms is reserved for buyers who have made a reservation online, by telephone or on site.

Players under 16 must be accompanied by an adult.

Players are requested to arrive 15 minutes before the game start time announced at the time of booking. Customers will be informed of this requirement, at the very least, at the time of booking, before payment, and in the booking confirmation e-mail. In the event of a delay, the game session cannot be postponed. Playing time will be reduced so as not to penalize subsequent bookings, and the session may under no circumstances exceed the end time stipulated when the order was booked.

Playing equipment is made available to players on condition that it is used fairly and with care, and that it is not damaged in any way. Musi'Quiz reserves the right to refuse access to the rooms in the event that at least one player is intoxicated or under the influence of illegal substances and behaves in a manner that threatens the staff.

‍ARTICLE 8 - RESERVATION MODIFICATIONS

‍ The absence of players at the time and date indicated will not entitle them to a refund or any consideration.

The purchaser may, however, request to modify his reservation free of charge up to 48 hours before the reservation date. Any modification must be made by e-mail or telephone to the Musi'Quiz center where the reservation was made.

ARTICLE 9 - NO RIGHT OF WITHDRAWAL

‍In accordance with the provisions of article L221-28-12° of the French Consumer Code, which stipulate that the right of withdrawal cannot be exercised for contracts for the provision of leisure activities that must be supplied on a specific date or at a specific time, the Buyer does not benefit from a right of withdrawal.

ARTICLE 10 - GIFTS

‍At the end of the Musi'Quiz performance, the player declared the winner of the game will receive a "Quiz Master" gift voucher for an amount equal to the price of one player, valid for a new room reservation within 3 months of the voucher being issued. This voucher will only be valid for a room reservation with a minimum of 4 players.

Only one gift voucher will be valid per room reservation. This gift voucher will be handed over personally at the end of the game. No duplicates will be issued in the event of loss of the "Quiz Master" gift voucher.

Customers who have booked a "Team Building" offer will receive a prize for the winners of the game session. In addition to the "Quiz Master" gift voucher, the winners will receive one or more Musi'Quiz related products (mug, flask, bottle opener, pen, for example) while stocks last and at the discretion of the Service Provider.

ARTICLE 11 - GIFT CARDS

Musi'Quiz offers reservations in the form of Gift Cards. These Gift Cards are represented by a ticket identified by a unique number, and the beneficiary is deemed to be the first person to use it. For this reason, it is the sole responsibility of the purchaser of a Gift Card to ensure that it remains confidential.

A Gift Card is valid for 12 months from the date of purchase. After this period, the card is no longer valid.

ARTICLE 12 - LIABILITY

‍Only facts that are directly attributable to Musi'Quiz, can engage the responsibility of the latter towards the Buyer or the players, subject to causing them direct harm.

Musi'Quiz cannot be held liable in the event that the non-performance or improper performance of its obligations is attributable to :

• Misuse of the Room and its functions by the Buyer or any Player;
• A fault attributable to the Buyer or any Player ;
• A case of force majeure, i.e. an unforeseeable and insurmountable act by a third party, and in particular: a general strike by public transport drivers, with more than 50% of the strike being attended by the professionals concerned, a technical failure of the game making it impossible for all Players to use it, an administrative closure of the Musi'Quiz establishment or a pandemic;
• A technical failure of the game that does not make it impossible for all Players to use it;
• Disadvantages inherent in the use of the Internet - such as interruption or breakdown of service, external intrusion or the presence of computer viruses.

In the event that the availability of a Room and the use of the game by all Players should prove impossible following a case of force majeure, Musi'Quiz undertakes to postpone, without charge, the execution of the Services ordered before the expiry of a period of three months from the date of initial availability.

The Buyer is responsible for the fair use of the leisure equipment by all Players and guarantees Musi'Quiz against any damage or injury of any kind to property, equipment, materials and persons inflicted by any Player during the performance of the Services; the Buyer may in no way invoke the absence of a subordinate relationship or contractual relationship with a Player to avoid Musi'Quiz's obligations.

In the event of damage inflicted by one or more Players linked to the Buyer's Order to goods or equipment belonging to Musi'Quiz establishments, repairs will be assessed and notified to the Buyer within sixty (60) days; the Buyer will have a period of fifteen days from the notification issued by Musi'Quiz to pay the cost of repairs, without delay of recourse to insurance.

In the event of late or non-payment, the Buyer shall be liable to pay a fixed indemnity for collection costs of 40 euros, ipso jure and without prior notice - in addition to the amount due plus interest for late payment.

ARTICLE 13 - INTELLECTUAL PROPERTY

‍All the content of the site and its elements are the property of Musi'Quiz. The same applies to graphic representations, present on the site and inside Musi'Quiz premises. Images, videos, photos and other documents are protected by copyright.

The game questions are also the property of Musi'Quiz.

Any total or partial reproduction of this content, without the prior authorization of Musi'Quiz, is strictly prohibited and may constitute an infringement of copyright.

‍ARTICLE 14 - PERSONAL DATA

‍1. The nominative data provided by the Buyer at the time of payment are necessary for the processing of his/her order and the preparation of invoices.

2. They are processed electronically. The purchaser can consult the Charter relating to the protection of Personal Data

ARTICLE 15 - MEDIATION

If a buyer does not find the proposed solution satisfactory, he or she may request mediation.

ARTICLE 16 - PHOTOS

Photographs or videos of the Players as a team may be taken before, during or at the end of the game, with the agreement of those concerned. These photos can be sent by e-mail to the author of the reservation. Musi'Quiz cannot be held responsible for any use made of these photos by the person making the reservation.

Musi'Quiz remains the owner of the photos and videos and reserves the right to use the photos taken during the game on its website and social networks affiliated with Musi'Quiz unless expressly opposed by at least one participant. Musi'Quiz will remove these photos at the request of any interested party.

ARTICLE 17 - APPLICABLE LAW AND JURISDICTION

‍1. The General Terms and Conditions are governed by French law.

2. The competent court in the event of a dispute shall be that of the defendant's place of residence, or, at the plaintiff's option, the place of actual delivery of the Product.
